Xarelto Lawsuits And Settlement Timeline

The initial Xarelto lawsuits regarding bleeding issues were filed against a Johnson & Johnson subsidiary and Bayer in early 2014. The trial dates for these cases are expected to begin during the second part of 2016. Although this may seem like a very slow process, individuals on both sides of the litigation are working to move things as efficiently as possible. At this time, there are no reports of settlements, although this is widely thought to be a potential outcome. Before settlement negotiations are able to begin, discovery and pretrial litigation will likely be completed.

In order to keep the many lawsuits moving, and because they include similar allegations, the United States Judicial Panel on Multidistrict Litigation formed the cases into Xarelto MDL in the Eastern District of Louisiana. They are being overseen by United States District Judge Eldon Fallon. As of mid-2015, the cases numbered around 2,000, but those involved expect to see several thousand more filings over the next few years.

At this time, Judge Fallon has indicated that early trials will review a small group of bellwether cases, no earlier than August of 2016. Bellwether cases are designed to streamline the legal process, eliminate duplicate discovery, and keep litigation running as quickly and smoothly as possible. These cases will serve as examples to help both the plaintiffs and defendants predict how the jury will respond to certain testimony or evidence during the course of future litigation.

As the initial trial dates draw near, it is expected that the courts will push Xarelto settlement negotiations to resolve claims. If the manufacturers neglect to settle things, it is possible that they will face much more liability as thousands of individual trials would require that they face courts across the country. If they decide to settle, there are several main factors considered to decide the amount of damages plaintiffs may be entitled to. Typically, these factors include things such as the extent of the pain, suffering, or injuries, and the amount of medical expenses the victims have endured, as well as the total sum of lost wages due to required time away from work.
